GoGoKar Terms of Service

Please read carefully the following Terms of Service that GoGoKar offers you access and use of our platform. Included there is important information about your legal rights, remedies and obligations in addition to some exclusions and restrictions.
These Terms of Service apply to all services provided by GoGoKar Inc. (a company registered in Canada Ontario with Ontario Corporation Number (OCN) 3313329 and registered office at 310 Bagot Street Kingston, ON, K7K 3B5 Canada.
GoGoKar Inc (hereinafter referred to as "GoGoKar", "we", "us", or "our") provides an online platform under the brand "GoGoKar" which introduces Drivers with empty seats in their vehicle who are making a Trip, with Passengers who are looking for a Trip to the same location and are searching for a means of transportation (the "Services"), which are offered through our website at www.gogokar.ca and our mobile application on the applicable app stores called "Gogokar" and any other subdomains or mobile applications which GoGoKar makes the Services available through. By using the Service, you understand and agree to be legally bound by these Terms of Service.
Please read these Terms of Service carefully as they have control over your access and use of the Service and all Members' (described below) and GoGoKar content. If you do not agree with the Terms of Service, your right to continue using or accessing the Service and all Members' and GoGoKar content will be denied Failure to adhere to the Terms of Service stated may expose you to civil and or criminal charges.
The Service is provided through our online platform whereby Drivers and Passengers may post and organize rides for the purpose of Carpooling directly with each other and not in a commercial or professional circumstance. By going ahead and using or accessing the Service, you confirm and acknowledge that GoGoKar is in no way a party to any agreements entered into between Drivers and Passengers and has no control over the conduct of Drivers, Passengers, or Members of our Service. You further agree and understand that GoGoKar is not an insurer, agent, or broker, and you also absolve us of all liability in this regard to the greatest extent allowed under the law.
1. Common Definitions
1.1 Member denotes a registered user of the GoGoKar platform, which includes both Drivers and Passengers.
1.2 A Driver is an individual who uses GoGoKar for the purpose of offering empty seats in their vehicle to Passengers.
1.3 A Passenger is a person who reserves a seat in a Driver's vehicle via the GoGoKar platform.
1.4 An Account refers to the profile created by Members to gain entry and use GoGoKar's services.
1.5 A Trip is a planned journey listed on GoGoKar, detailing the origin, destination, time, date, pick-up and drop-off points, number of seats, and available space for luggage.
1.6 Booking is the process where a Passenger pays the Contribution through GoGoKar in advance to confirm a seat on a Trip.
1.7 Request is posted by a Passenger seeking a Trip for a specific date between two points.
1.8 Contribution or Trip Contribution is the amount paid by a Passenger to a Driver to help cover the expenses of the Trip. This is not intended for profit.
1.9 One-Time Booking Fee is a service fee charged to a Passenger each time they book a Trip through GoGoKar, unless they have an active Membership.
1.10 Membership Fee is a yearly subscription fee paid by a Passenger to become a member. Members with an active subscription may still incur a Stripe transaction fee when using the secure payment method.
1.11 Payment is the total amount paid by a Passenger, including the Contribution, the One-Time Booking Fee (if applicable), and any Stripe processing fees (if applicable).
1.12 Payout is the sum of Contributions that GoGoKar transfers to a Driver after a Trip.
1.13 Payout Fee is deducted from a Driver's Payout as a service fee. (if applicable)
1.14 Payout Method refers to how a Driver receives their Payout—either via bank transfer or PayPal.
1.15 Cancellation Allowance allows a Driver to cancel one Trip with confirmed Passengers or one approved Booking every six months without penalty.
1.16 Carpooling/Ridesharing refers to the practice of sharing a Trip in a private vehicle between Drivers and Passengers in exchange for a Contribution.
2. Changes to the Terms of Service
2.1 GoGoKar may update or revise these Terms of Service at its discretion. Updates will be posted on the platform and the "Last Updated" date will be modified accordingly. Continued use of the platform indicates acceptance of the modified Terms. If you disagree with the changes, you must stop using the service.
3. Your Responsibilities
3.1 GoGoKar requires Members to verify their identity via email or phone number.
3.2 GoGoKar does not perform background checks.
3.3 Members are encouraged to use common sense when interacting with others and report any inappropriate behavior.
3.4 GoGoKar is not liable for interactions between Members.
3.5 By using GoGoKar, you release GoGoKar and its affiliates from any claims or damage resulting from disputes with other users, except as restricted by local consumer protection laws.
4. Your Conduct
4.1 Drive safely and within the law.
4.2 Do not infringe on others' rights.
4.3 Avoid unauthorized use of the platform's information.
4.4 Do not tamper with or damage the platform.
4.5 Refrain from sending spam.
4.6 Respect other Members—no harassment or abuse.
4.7 Do not use GoGoKar for commercial purposes unless authorized.
4.8 Be at least 18 years old.
4.9 Do not register on behalf of another person.
4.10 Report inappropriate behavior.
5. Use and Access of the Service
5.1 GoGoKar is intended solely for personal, non-commercial Carpooling arrangements.
5.2 Drivers cannot use the platform for profit or offer services such as delivery or taxi-like services.
5.3 Any Trip listed must reflect confirmed travel plans.
5.4 Use of the platform in a professional or commercial context may violate insurance coverage and result in account suspension.
5.5 GoGoKar is not a transportation provider and acts only as a platform to connect users.
6. Accessing the Carpool Service
6.1 Register via email or OAuth (Google/Facebook).
6.2 Verify your contact info.
6.3 Provide a clear profile photo, age, gender, and description.
6.4 Agree to GoGoKar's Terms and Privacy Policy.
6.5 Only one account per Member is permitted.
6.6 You are responsible for safeguarding your login credentials.
7. Eligibility
7.1 GoGoKar reserves the right to limit or revoke service access at its discretion.
8. Features of the Service
8.1 Drivers create Trips with full details.
8.2 Communication is managed through GoGoKar's messaging system.
8.3 No personal contact details may be exchanged until you have paid the Membership Fee or purchase a one-time booking token.
9. Bookings
9.1 Bookings are made through online payments via the GoGoKar platform, or directly with the Driver using other means of payment, provided that the Passenger is either a Member with an active Membership or has paid the One-Time Booking Fee for that Trip.
9.2 Drivers may choose between "Request to Book" or "Instant Book" options.
9.3 Confirmed Bookings are binding and subject to the cancellation policy.
10. Payments
10.1 All online payments are processed in CAD via Stripe.
10.2 Online contributions are held in escrow and paid out after a 4-day dispute window.
11. Payouts
11.1 Drivers must set a valid Payout method to receive funds.
11.2 Payouts are processed daily.
11.3 Additional processing time may apply depending on the selected method.
11.4 If unclaimed within 365 days, funds are forfeited.
12. Conditions to Receive Payment
12.1 Drivers must arrive on time.
12.2 Inform Passengers of any changes.
12.3 Wait until the agreed departure time.
12.4 Complete the Trip safely.
12.5 Failure to meet these conditions may result in forfeited Payouts and account suspension.
13. Cancellations and No-Shows
13.1 Drivers and Passengers are bound by the cancellation and no-show policies.
13.2 Repeated cancellations or no-shows may result in account review or suspension.
13.3 Disputes must be raised within four (4) days of the Trip's scheduled departure.
13.4 If a rider purchases a one-time booking token and the driver cancels the trip, the one-time booking token becomes valid again and reusable until a ride has been successfully taken. However, it cannot be refunded.
14. License and Insurance
14.1 Drivers must have a full, valid Driver's License and adequate insurance.
14.2 Using GoGoKar for unauthorized commercial activities may void insurance and result in account suspension.
15. Identity Verification
15.1 GoGoKar may request identity documents at any time.
15.2 Verification enhances safety but is not a guarantee of trustworthiness.
16. Referral Program
16.1 Members can earn Promo Codes by referring new users to the GoGoKar platform. The referral reward is granted once the referred user has successfully signed up and purchased a Membership. The earned reward can either be:
- (a) cashed out by the Member via bank transfer, or
- (b) converted into GoGoKar credits, which can be used to pay for future Trips on the platform.
16.2 Terms apply and may be updated at GoGoKar's discretion.
16.3 Misuse may result in disqualification from the program.
17. Community Agreement
17.1 By using the platform, you agree to follow the standards outlined in GoGoKar's Community Agreement.
18. Anti-Discrimination and Harassment
18.1 GoGoKar enforces strict anti-discrimination and anti-harassment policies.
18.2 Violations may result in permanent account suspension.
19. Privacy
19.1 Your data is handled in accordance with GoGoKar's Privacy Policy.
20. Legal
20.1 Liability: GoGoKar's maximum liability is $25, except where otherwise required by law.
20.2 Warranties: Service is provided "as is" without warranties.
20.3 Indemnity: Members agree to indemnify GoGoKar against claims arising from misuse of the service.
20.4 IP Rights: All site content is protected and may not be copied without permission.
21. Termination
21.1 GoGoKar may suspend or terminate your access at any time for breach or misuse.
Cancellation Policy
Passenger Cancellation Policy
- When you cancel less than 24 hours from the departure time: You get a 50%* refund of the base ticket price (minus stripe fees)
- When you cancel more than 24 hours before departure time: You get a full *refund of the base ticket price (minus stripe fees)
- When you cancel after departure time or don't show up: You do not get a refund
- If your driver cancels your trip: You get a 100% refund, including all fees
- If you purchase a one-time booking token and the driver cancels the trip, the one-time booking token becomes valid again and reusable until a ride has been successfully taken. However, it cannot be refunded.
* In the case of multiple tickets being purchased on a single booking the system cannot refund individual persons for additional services such as extra luggage and home pickup/drop-offs. However, if the entire booking is canceled, you will be refunded for these additional services
Driver Cancellation Policy
- As a driver you can cancel a trip at any time if there are no booked riders, and no penalty will apply.
- You can cancel up to a maximum one booked ride in a six-month period. If you cancel more than one booked ride, you account may be put under review and you may be suspended.
- When a Driver cancels a Trip (with approved Booking(s)) or an approved Booking:
- Passenger(s) will be refunded 100% of the Trip
- You will receive an automatic cancellation review on your profile and if the GoGoKar team determines
- that you were at fault, the cancellation will count to your six-month allowance
- that you are not at fault, the cancellation will not count towards your six-month allowance
Driver no-show policy
If you do not show up, for a trip with booked passengers, this could lead to an immediate account termination.
Driver payouts:
GoGoKar charges a 2% on payouts plus a $2 monthly maintenance fee charged by STRIPE on all active accounts which will be deducted from the first payout of each month.
